1. Acceptance of Terms
By downloading, installing, or using Assistrix (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.
These Terms of Use constitute a legally binding agreement between you and Henrique Lima da Silva ("we," "our," or "us").
2. Description of Service
The App is a subscription management tool designed to help you track and manage your subscriptions. The App operates entirely on your iOS device and does not require internet connectivity for core functionality.
3. License Grant
Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your iOS device for personal, non-commercial purposes.
4. Restrictions
You agree not to:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright, trademark, or other proprietary notices from the App
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any part of the App
- Use the App in any way that could damage, disable, or impair the App
5. User Responsibilities
You are responsible for:
- Maintaining the security of your device and any data stored within the App
- Ensuring the accuracy of information you enter into the App
- Backing up your data as needed, as data loss may occur if the App is deleted or your device is damaged
- Using the App in compliance with all applicable laws and regulations
6. Data and Privacy
All data entered into the App is stored locally on your device. We do not collect, access, or process any of your data. For more information about how we handle your data, please review our Privacy Policy.
You are solely responsible for maintaining backups of your data. We are not responsible for any loss of data.
7. Subscriptions and Payments
Subscription Service: Assistrix offers premium features through a subscription service. By subscribing, you gain access to additional functionality within the App.
Payment: Subscriptions are processed through the Apple App Store. Payment will be charged to your Apple ID account at the confirmation of purchase. All transactions are subject to Apple's terms and conditions.
Automatic Renewal: Unless you cancel at least 24 hours before the end of the current period, your subscription will automatically renew. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the cost of the chosen subscription.
Subscription Management: You can manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase. You may cancel your subscription at any time, but cancellation will not take effect until the end of the current billing period.
Price Changes: We reserve the right to modify subscription prices at any time. Price changes will take effect at your next subscription renewal. You will be notified of any price changes in advance.
Refunds: Refund requests are handled by Apple in accordance with Apple's refund policy. We do not process refunds directly. If you are eligible for a refund, please contact Apple Support.
Free Trial: If offered, any free trial period will be clearly stated at the time of subscription. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless cancelled before the trial ends.
Access to Premium Features: Access to premium features is granted immediately upon successful subscription purchase and will continue for the duration of your active subscription period.
8. Intellectual Property
The App, including its design, code, graphics, and all other content, is the property of Henrique Lima da Silva and is protected by copyright, trademark, and other intellectual property laws.
All rights not expressly granted to you are reserved by us.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.
Our total liability for any claims arising from or related to the App or your subscription shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim, if any.
11. Indemnification
You agree to indemnify, defend, and hold harmless Henrique Lima da Silva from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the App or violation of these Terms of Use.
12. Updates and Modifications
We reserve the right to modify, update, or discontinue the App at any time. We may also update these Terms of Use from time to time. Continued use of the App after such changes constitutes acceptance of the modified terms.
13. Termination
We may terminate or suspend your access to the App, including premium features, at any time, with or without cause, with or without notice, for any reason, including violation of these Terms of Use.
You may stop using the App at any time by deleting it from your device. Cancellation of your subscription does not entitle you to a refund for any unused portion of your subscription period.
Upon termination, your right to use the App and access premium features will immediately cease. All provisions of these Terms of Use that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, and limitations of liability.
14. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.
For users in the European Union, these Terms of Use are subject to applicable EU consumer protection laws.
15. Dispute Resolution
Any disputes arising out of or relating to these Terms of Use or the App shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiations, it shall be subject to the exclusive jurisdiction of the courts of Brazil.
EU users have the right to bring proceedings in their country of residence or in Brazil.
16. Severability
If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
